Auctioneer - Credentialing

1). Must be at least 18 years of age.

2). Hold a current seller's permit issued by the Department of Revenue, unless exempt. Please confer with the Department of Revenue - seller's permit (608) 266-2776.

3). Pass an examination to determine fitness as an auctioneer. Examination scores are valid for one year. The application for licensure must be submitted within one year of passing the examination. The Department does not offer examination preparation courses.

******* As of September 1, 2009 the Department of Regulation and Licensing will be administering the exam at our office in Madison. To register for an exam date download, complete and submit the Application for Auctioneer Registration, Form # 2077, located at the Forms link to the left of this page. After receipt and processing of a complete application an admission ticket will be generated for the exam. Admission tickets are mailed approximately two weeks prior to the exam date:

This registration does not apply to any of the following situations.

1. An auction conducted by or under the direction of an official of the United States or of this state or a county, city, village or town in this state.
2. An auction required by a court order or judgment.
3. A sale of goods or real estate required by law to be a sale by auction.
4. An auction conducted by the owner of the goods or real estate for sale if the owner has held the goods or real estate for his or her personal use for at least one year immediately preceding the date of the auction.
5. An auction conducted by or under the direction of a religious, fraternal or benevolent society, a school or a nonprofit organization.
6. An auction conducted by or under the direction of a political organization or candidate if the proceeds of the auction will be used for political purposes.
7. An auction in which the total appraised value of the goods or services for sale is less than $500.
8. Fur auctions and fur auctioneers licensed by the department of natural resources under ch. 29, Wis. Stats.
9. Motor vehicle auction dealers licensed by the department of transportation under subch. VIII of ch. 218, Wis. Stats.
10. A person, other than a licensee as defined in s. 452.01(5), Wis. Stats., who conducts an auction, or manages or has primary responsibility for handling sales proceeds, downpayments, earnest money deposits or other trust funds received at or as a result of an auction, while lawfully practicing within the scope of a license, permit or certificate granted to that person by a state governmental agency other than the department.

 

4).  Temporary Permit:  A temporary permit may be issued for 60 days and may not be renewed.  If you fail the exam, you will be able to retake the exam; however, when the 60 day period has ended, you must have either passed the exam and have been registered as an auctioneer or you will have to cease functioning as an auctioneer until you pass the exam and are registered.  Exam questions will be based on the information contained in the Wisconsin Statutes and Administrative Rules Relating to the Practice of Auctioneers and Auction Companies. Upon passing the examination, you will receive an Application for Auctioneer Registration (form #2077) that you must submit to the Department with the $53 initial credential fee.

Common Denial Reason: Cannot meet above requirements.

Convictions of crimes or pending charges may be grounds for denial of license if the circumstances of the conviction or charge are substantially related to professional practice.
